KAZAKHSTAN: a new mandatory condition for foreign citizens in employment

An additional condition has been introduced in the Labor Code, and from now on a foreign citizen is obliged to provide an imputed medical insurance contract covering primary medical and sanitary care and specialized medical care in hospital conditions in emergency form to the future Employer, before signing the employment contract. Liability for non-compliance lies entirely with the employer. Liability for non-compliance lies entirely with the employer.

Following the update of the Labor Code, the issue of applying this law to foreign workers from EAEU countries appeared. From the explanation of Vice Minister Akmadi Adilovich Sarbasov, it follows that laborers from the EAEU countries are obliged to provide an additional insurance contract to the future employer: mandatory contributions to health insurance cover routine consultative and diagnostic services, inpatient treatment, medicines at the outpatient level and medical rehabilitation on an equal footing with Kazakhstani citizens, but not emergency care.

It is worth noting that for foreign workers from EAEU member states and Kazakhstani workers, the size of contributions to health insurance is the same and in total both contributions are 5% from gross salary monthly while employment.
