Poland Introduces Major Changes to Hiring Foreign Workers Starting June 1, 2025

FCHAIN Poland office informs:

Effective June 1, 2025, Poland will implement significant reforms aimed at tightening the rules for employing foreign workers while streamlining administrative procedures. The new law, signed in April, introduces both stricter enforcement and modernized processes.

Key Changes:

Abolition of the Labor Market Test
The requirement for employers to prove that no Polish candidates are available for a job before hiring foreigners will be completely removed. Instead, local authorities (powiat offices) will be empowered to create lists of occupations where the employment of foreigners may be restricted, depending on local labor market conditions.

Full Digitalization of Work Permit Applications
The entire process of applying for work permits will be digitized. Authorities have two years to fully adapt their systems, promising faster and more transparent procedures.

Stricter Penalties for Violations
Employers found violating employment rules will face fines ranging from 3,000 to 50,000 PLN. Companies primarily engaged in securing legal stay and work documents for foreigners—without actual job offers—will be denied further work permits.

Support Centers for Foreigners
New support points will be established at county employment offices to help foreigners integrate and find legal employment more easily.

Restrictions on Economic Activities
A closed list of economic activities will be defined, clarifying which types of jobs and businesses foreigners are allowed to engage in.

These changes aim to combat abuse in the foreign labor market, protect workers’ rights, and improve administrative efficiency. However, they also introduce new limits and controls that employers and foreign workers will need to navigate carefully.
