KAZAKHSTAN: Update on the Temporary Residence Permit rules (TRP), JANUARY 2023

A complication of the rules for obtaining the Temporary Residence Permit in the Republic of Kazakhstan (TRP) for citizens of the EAEU countries.

The Rules for issuing Permits for temporary and permanent residence in the Republic of Kazakhstan to foreigners and stateless persons were amended by Order No. 6 dated January 6, 2023, to:

  • Requirements for the provision of the public service “Issuance of temporary residence permits to foreigners and stateless persons in the Republic of Kazakhstan to carry out labor activities” (added grounds for refusing to issue a permit may be an excess of the number of valid TRPs (more than five) issued to the employer on the basis of the labor contracts for the performance of work (provision of services) in the household, on the basis of paragraph 5 of Article 43-2 of the Law).
  • Requirements for the provision of the public service “Issuance to foreigners and stateless persons of a temporary residence permit in the Republic of Kazakhstan for carrying out entrepreneurial activities in accordance with the legislation of the Republic of Kazakhstan (for business immigrants).

In both public services, a requirement was added that if the recipient of the service is not the owner of the housing provided to the immigrant for his temporary residence, then the physical presence of the owner of the property provided or his notarized consent to the residence of the immigrant is mandatory.

 

The government of Kazakhstan has amended the rules for the entry and stay of immigrants in the country, which will limit the period of stay of foreigners in the Republic of Kazakhstan.

According to the new amendments, if a foreigner arrived in Kazakhstan in a manner that does not require a visa, then he/she will have to leave the republic 30 calendar days after crossing the border of Kazakhstan. At the same time, in total, he/she will be able to stay in Kazakhstan for 90 calendar days during each period of 180 calendar days. For citizens of the member states of the Eurasian Economic Union, the period of stay ends after 90 calendar days from the date of crossing the state border of Kazakhstan. At the same time, they will also be able to stay in Kazakhstan for only 90 days in every 180 days.

Thus, the practice of visa-run will not work for individuals without a Temporary Residence Permit TRP.
